Terms of Service

1. Acceptance of Terms

By creating an account or using hiAIre ("the Service"), you agree to these Terms of Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these terms.

2. Description of Service

hiAIre provides AI-powered work simulation assessments for hiring. Employers create accounts, invite candidates to timed simulations, and receive AI-generated fluency scores and behavioral analysis. The Service includes simulation generation, AI assistant interaction, scoring, and reporting.

3. Account Types

• Employer accounts: Create simulations, invite candidates, view scores and reports, manage team members and billing.
• Candidate accounts: Created via employer invitation. Complete simulations and view completion status.

You are responsible for maintaining the security of your account credentials.

4. Free Trial

New employer accounts receive a 14-day free trial with 5 simulation runs. No credit card is required. After the trial ends, a paid subscription is required to run additional simulations. Existing simulation data and scorecards remain accessible.

5. Subscriptions and Billing

• Paid plans are billed monthly or annually via Stripe.
• Simulation allocations reset each billing period and do not roll over.
• Monthly plans can be cancelled anytime. Access continues through the end of the billing period.
• Annual plans can be cancelled but are non-refundable for the remaining term.
• We may change pricing with 30 days notice. Existing subscriptions are honored until renewal.

6. Acceptable Use

You agree not to:

• Share, record, or redistribute simulation content, scenarios, or scoring methodology.
• Attempt to reverse-engineer the scoring engine or AI trap mechanics.
• Create accounts to preview simulations as a candidate (if you are an employer).
• Use the Service for any purpose other than legitimate hiring assessment.
• Attempt to circumvent usage limits, rate limiting, or security measures.

7. Intellectual Property

All simulation scenarios, scoring algorithms, AI prompts, trap mechanics, and platform design are proprietary to hiAIre. Employers receive a license to use assessment results for hiring decisions. Candidate deliverables remain the intellectual property of the candidate but are licensed to the employer for assessment purposes.

8. AI-Generated Content

Simulations include AI-generated scenarios, stakeholder messages, and scoring. While we strive for accuracy and fairness, AI-generated content may contain errors. Scores should inform hiring decisions alongside other evaluation methods, not replace them entirely.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and processing of data as described therein.

10. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications to the Service. If a simulation is interrupted due to a platform issue, we will provide a replacement simulation run.

11. Limitation of Liability

hiAIre is provided "as is." We are not liable for hiring decisions made based on simulation scores. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

12. Account Termination

You may close your account at any time from Settings. We may suspend or terminate accounts that violate these terms. Upon termination, all data is permanently deleted as described in our Privacy Policy.

13. Changes to Terms

We may update these terms periodically. Material changes will be communicated via email at least 30 days before taking effect. Continued use after changes constitutes acceptance.
